Universal Molding Company Downey CA -Aluminum Extrusion UMEX Stormwater Free Product Flow Jan 9 2018 UNIVERSAL MOLDING COMPANY, INC.-UMC dba UNIVERSAL MOLDING EXTRUSION COMPANY, INC., a corporation-UMEX located at 9151 Imperial Hwy, Downey California is owned by Dominick L. Baione-CEO (sons James P. Baione-President of UMC based in New York City and Jeff Baione-Plant Manager of International Window Corporation, Fullerton based in the Los Angeles Area). FACTS:
1. Four months and a week after an employee stated "they know had bad shit is here" in preparation for an inspection (see other video on this channel from Aug 30, 2017 entitled "Stormwater Inspection" ), the facility's best management practices were well below standards, i.e. UMEX/UMC did not implement the required best management practices. Employee referred to the "storm shit", "all that bullshit" and stated that the company is stupid on August 30, 2017. Then the big rain came.
2 The clearly visible "free product" "sheen" slops off an on-site, large, unlined pit/pond overfilled with water, and then breaks through an ineffective straw wattle containment during pouring rain on January 9, 2018. The in force UMEX Spill Prevention Control and Countermeasure (SPCC) Plan dated December 2016 states "A major spill outside the physical structure of the facility is defined as one in which a quantity of any hydraulic oil or petroleum related products has entered, or will enter, the storm system".
3. The breached "free product" flowed toward a storm drain and eventually to the Bay/Pacific Ocean. No boom, sorbent, and other spill response techniques were used by UMEX personnel to stop or contain the major spill of free product (hydraulic oil or petroleum related products). UMEX failed to contain, recover or notify as required per their in force SPCC Plan, Section 5.3, page 25. UMEX did not notify Federal or State Authorities as required in Appendix H of the UMEX SPCC Plan (see page 102).
4. The large, unlined pit/pond/lagoon was located directly beneath the former outdoor aluminum log cutting (saw) operation within the UMEX compound. The saw operation had a history of a. numerous, uncontained hydraulic oil releases on the ground surface, and b. large quantities of aluminum log saw cuttings/chips on the ground. The large, unlined pit/pond/lagoon served as a waste pit for it collected runoff from the outdoor Hazardous Waste Accumulation Area (HWAA) with a history poor practices (lack of secondary containment, improper disposal practices, exposed wastes, etc.). The HWAA is located less than one-hundred feet upstream from the former waste pit, i.e. runoff from the HWAA flowed into and filled the former waste pit.
5. An active city of Downey drinking water well (City of Downey Water Well #30) is located adjacent to the facility and near the southwest corner of the UMEX compound. The former waste pit (~50 ft north of the NW corner of the main production building in UMEX compound) was located approximately 500 feet from City of Downey Water Well #30.
6. One year prior, UMC had not installed all its required Clean Water Act “best management practices” equipment from its updated stormwater SWPPP plans in the time frame of January 5-7, 2017 (see below after the named parties in the Federal lawsuit).

Definitions:
1) Free product – Any petroleum contamination that exists as a separate material that does not mix with or dissolve in water.
2) Sheen - A very thin layer of oil (less than 0.0001 inches or 0.003 mm) floating on the water surface. Petroleum sheens vary in color ranging from rainbows, grays, and silvers for the thicker layers to almost transparent for the thinnest layers.
