Videos can use content-based copyright law contains reasonable use Fair Use (  Scooter Braun and Scott Brochetta’s Big Machine Records might claim they aren’t blocking Taylor Swift from performing her own songs, but the singer’s team just revealed some pretty contradictory facts about the matter.  Taylor’s publicist Tree Paine was quick to act on Friday afternoon and released her response to the company’s statement in which she claimed they had used clever wording to try and hide their actions as seen in a private email.  ‘The truth is, on October 28, 2019 at 5:17 p.m. the Vice President, Rights Management and Business Affairs from Big Machine Label Group sent Taylor Swift‘s team the following: “Please be advised that BMLG will not agree to issue licenses for existing recordings or waivers of its re-recording restrictions in connection with these two projects: The Netflix documentary and The Alibaba ‘Double Eleven’ event.”’ her Twitter statement read.  ‘To avoid an argument over rights, Taylor performed three songs off her new album Lover at the Double Eleven events as it was clear that Big Machine Label Group felt any televised performance of catalog songs violated her agreement.’  She then added that BMR has specifically blocked Taylor from her project with Netflix and her American Music Awards performance: ‘In addition, yesterday Scott Borchetta, CEO and founder of Big Machine Label Group, flatly denied the request for both American Music Awards and Netflix.  ‘Please notice in Big Machine’s statement, they never actually deny either claim Taylor said last night in her post.’    Before the statement concluded with another bombshell about the battle for money between the two camps: ‘Lastly, Big Machine is trying to deflect and make this about money by saying she owes them but, an independent, professional auditor has determined that Big Machine owes Taylor $7.9 million dollars of unpaid royalties over several years.’  Nowhere in the BMR statement does it explicitly state that the company hasn’t denied Taylor’s request to perform her old songs at the AMAs or use her back catalogue of material for her Netflix documentary.  So now we’re anticipating another statement from the record label because Taylor’s fans definitely aren’t happy with them right now – and neither are a lot of people in the media industry.  We just hope this all comes to a happy conclusion soon.
